Asking for a permit to leave prison

Summary: Applying to leave your prison temporarily so you can do things like to go to a funeral or a private medical appointment.

There are some reasons you can leave prison temporarily. Some examples are to:

  • Go to a medical appointment
  • Go to a funeral
  • Participate in a program
  • Work
  • Visit family

If you want to get temporary leave from prison, you will need to apply for a:

  • Custodial Community Permit (to stay within Victoria); or
  • Custodial Interstate Community Permit (to go interstate).

What is a Custodial Community Permit (CCP)?

CCPs allow people to leave prison temporarily to go somewhere in Victoria for certain reasons. The laws about CCPs come from Division 3, Part 8 of the Corrections Act 1986 (Vic)Temporary Absence from Prison.

There are three types of CCPs:

  1. Corrections Administration Permit
  2. Rehabilitation and Transition Permit
  3. Fine Default Permit

What is a Custodial Interstate Community Permit (CICP)?

CICPs allow people to leave prison temporarily and go to another state for certain reasons. Those reasons are:

  • To visit a person you have a long-standing personal relationship with, if that person is seriously ill or in ‘acute personal need’
  • To attend a funeral of a person you have a long-standing personal relationship with
  • For other compassionate purposes (including for an Aboriginal person in prison to attend occasions that have special significance to their family)
