What happens if I breach my parole?

The Adult Parole Board can re-consider your parole if:

  • You are not complying with your parole conditions; or
  • You re-offend while you are on parole; or
  • Your risk of re-offending is increasing.

The Board can be notified about one of these issues by your parole officer or by Victoria Police.

After they have been informed of a breach or increasing risk, the Adult Parole Board will consider the situation, and decide whether to either:

  1. Cancel your parole, returning you to prison to complete your sentence; or
  2. Give you a warning; or
  3. Change your parole conditions.

To help make their decision, the Board might interview you, parole officers or other Corrections Victoria staff. Their number one consideration when making a parole decision is the protection and safety of the community.

Arrest by Victoria Police

If Victoria Police find out that you have breached your parole, either by breaking your conditions or re-offending, they can arrest you. They must tell the Adult Parole Board about your arrest within 12 hours. The Board will then decide if you should stay in custody while they make a decision about your parole. If the Board decides you should stay in custody, they will meet to make a parole decision either that same day or the next working day (Monday – Friday).

Important:

  1. Some parole breaches can result in you being charged with a separate criminal offence.
  2. Your parole can be cancelled if you are accused of committing an offence – the Board does not have to wait for you to be found guilty in criminal court.
