Decisions by a treaty body

The Committee will make a decision that either:

  1. Your human right was breached; or
  2. No human right was breached.

Once the Committee has a decision, they will let you and the government know at the same time.

The decision will also be put on the OHCHR website.

  1. There was a breach of a human right

If the Committee decides there was abreach of a human right,they will say so and give recommendations to the government about what they should do.

The Committee will ask the government to report back within 180 days about what they are doing to implement the recommendations.

The government’s response will be given to you for review and to make any comments.

If the government doesn’t follow the recommendations, the Committee will keep meeting with the government until they believe right measures have been taken. These meetings are public.

Important: the Committee cannot force a government to do anything.

  1. There was no breach of a human right

If the Committee decides there was no breach of a human right, the case is closed.

Can I appeal a decision by the Committee?

There is no option to appeal a decision made by a Committee.
