Complaints about health information privacy

A complaint about health information privacy is about the handling, use or sharing of your health information by the prison or its staff.

Health information is information about your physical or mental health. It can include details about a medical condition or mental health diagnosis, medications, test and urinalysis results, or notes made by treating clinicians like doctors or psychiatrists.

Examples of health information privacy complaints might be:

  • A prison officer or health service worker looking at or sharing your health information without your permission and without a good reason
  • The prison requesting medical information about you from a hospital or doctor in the community without your consent

There are 3 steps you can take about a health information privacy complaint:

  1. Raise your complaint with the Privacy Contact Officer at your prison
  2. Contact DJCS Information Privacy Unit
  3. Contact the Health Complaints Commissioner
